Terms of Service

These terms govern your use of Planiva.

1. About these terms

These terms govern your use of Planiva (the “service”). Planiva provides personal financial planning tools and a scenario workbench for exploring and organising financial decisions. The service may include tools covering areas such as cashflow, retirement, tax, capital gains and disposal planning, estate planning and other related topics over time. By using the service, you agree to these terms.

2. Consumer and business use

Consumer means you are using the service for your own personal purposes.

Business user means you are using the service in the course of business, trade or profession, including financial advisers or anyone using the service with or for clients.

The service is designed primarily for consumers. Business users may use the service, but it is not designed or warranted for professional use and business users use it at their own risk.

3. Eligibility and your account

You are responsible for maintaining the confidentiality of your account and for activity under it. You must provide accurate information where requested.

The service is not intended for children under 16. You must not use the service to create accounts for, or intentionally store personal data about, children under 16.

4. Beta status, pricing, and changes

The service may be provided free of charge during a beta period. We may introduce paid plans, change pricing, add or remove tools, or change the features available on free and paid plans. Paid access may be offered as a single bundled subscription that unlocks selected tools, or `All Access` under one account. We will provide reasonable notice of material changes where practical.

We may modify, suspend, or discontinue any part of the service at any time. We will try to give notice where reasonably possible.

If we offer annual subscriptions, they renew automatically on each anniversary unless cancelled before renewal in accordance with the applicable subscription terms.

If a subscription includes access to new tools added during an active paid term, that access is included for the remainder of the current term. Any revised pricing for a renewed or expanded subscription would apply from the next renewal date unless we state otherwise.

For monthly subscriptions, where the addition of new tools affects the price of a bundle or `All Access` subscription, any increased price applies from the first renewal date that falls at least 30 days after notice is given, unless a longer notice period is required by law.

5. Information only, not financial advice

The service provides tools and information for planning and education. It does not provide financial, tax, legal, or investment advice, and it is not a regulated financial advice service.

Outputs are illustrative and depend on the information you enter, the assumptions used, and the scope of the relevant tool. You should obtain independent professional advice before making financial decisions.

You agree that you will not rely on outputs as the sole basis for financial decisions.

If you are a business user, you must not present outputs as advice from us, and you are responsible for ensuring your own compliance with any professional and regulatory obligations.

6. Your responsibility for inputs and decisions

You are responsible for the accuracy and completeness of the information you enter. Outputs can change materially with different inputs, assumptions, tax rules, market conditions, and personal circumstances.

Some features may use optional profile details you provide to apply default assumptions or personalise the service. For example, some tools may use age, date of birth, gender, names, relationship details, or other profile information where relevant to the feature. You should review and adjust assumptions before relying on outputs. Defaults are illustrative only.

Names, notes, and similar profile or record labels are generally for personalisation and organisation only unless the service explicitly states otherwise.

7. If you enter information about other people

If you enter information relating to another person (for example a partner, family member, beneficiary, executor, co-owner or client), you confirm you have the right to provide that information and to allow us to process it in accordance with our Privacy Policy. You are responsible for how you use outputs with or for other people.

8. No warranties

To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. We do not warrant that:

  • calculations, projections, reports, or other outputs are accurate, complete, or up to date,
  • the service will meet your requirements, or
  • the service will be uninterrupted or error free.

If you are a consumer, nothing in these terms affects your statutory rights.

9. Limitation of liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

For consumers: the service is provided for information only. To the extent permitted by law, we are not liable for losses arising from your reliance on projections or outputs, or decisions you make using the service. We are not liable for any indirect or consequential loss. This does not affect liability that cannot be excluded by law.

For business users: to the maximum extent permitted by law, we exclude all liability for loss of profit, loss of revenue, loss of business, business interruption, loss of data, and any indirect or consequential loss. Our total liability to you for any claim arising out of or in connection with the service (whether in contract, tort including negligence, misrepresentation, restitution or otherwise) is limited to £1.

10. Acceptable use

You must not:

  • misuse the service, attempt unauthorised access, or interfere with its operation,
  • scrape, crawl, or harvest data at scale,
  • reverse engineer, copy, or create derivative works except where permitted by law,
  • use the service to provide regulated advice or in a way that implies endorsement, certification, or approval by us,
  • input unlawful content or content that infringes the rights of others.

11. Intellectual property

We retain all rights in the service, software, content, and branding. You may use the service only as permitted by these terms.

12. Anonymised data

We may create and use anonymised and aggregated data derived from use of the service for analytics, benchmarking, research, reporting, product improvement, feature development, and commercial purposes, including sharing with third parties.

13. Communications

We may send you emails and other messages about the service. These include:

  • Service messages needed to operate your account (for example security notices and important changes).
  • Non-essential messages such as beta updates, new feature announcements, surveys, and feedback requests. Where required, you will be able to opt out of non-essential messages.

For more information, see our Privacy Policy.

14. Privacy

Our Privacy Policy explains how we process personal data.

Where we use optional analytics technologies such as Google Analytics, they are subject to your cookie consent choices. Necessary cookies required to provide and secure the service may still be used.

15. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, subject to any mandatory rights you may have under applicable consumer law.
